FISCAL NOTE

 

DESCRIPTION:        AN ACT TO AMEND TITLES 18 AND 19 OF THE DELAWARE CODE RELATING TO WORKERS' COMPENSATION INSURANCE.

 

 

ASSUMPTIONS:


1.     This legislation creates the Workers’ Compensation Oversight Panel and charges the Department of Labor with providing staff support to this Panel. 

2.     The Workers’ Compensation Oversight Panel is a combination of two committees: the Health Care Advisory Panel which is currently supported by the Department of Labor and the Data Collection Committee which is currently supported by the Department of Insurance.  

3.     This legislation also requires the Department of Labor to provide staff support for the Panel in its retention and oversight responsibilities for the Ratepayer Advocate.

4.     The Department of Labor will require 1 FTE Management Analyst III with an annual salary and OEC rate of $73,000.  This position will be funded through the Department’s administrative expense assessment on insurance carriers and will have no general fund impact.  The Management Analyst III will provide administrative support to the Workers’ Compensation Oversight Panel and will coordinate and attend all Panel and subcommittee meetings; will send meeting notices and will prepare and distribute meeting materials; and will research, create, and draft technically complicated reports for members. In addition, this position will also serve as a liaison between the Delaware Compensation Rating Bureau and Panel members.  This position will also serve as a point of contact for the public regarding the work of the Panel and will field Workers Compensation questions.

5.     This analysis assumes there will be 10 months of employee related costs in FY 15 and a full year of costs in FY 16 and FY 17.

Cost:

            Fiscal Year 2015            $60,800 ASF (10 months)

            Fiscal Year 2016            $73,000 ASF

            Fiscal Year 2017            $73,000 ASF
