SENATE AMENDMENT NO. 3

TO

AMEND House Bill No. 56 by deleting on line 9 “The use” and substituting in lieu thereof “The disclosure”.

FURTHER AMEND House Bill No. 56 by inserting the following beginning after  line 15:

                (f)  For purposes of this section, a data reporting device is any device that is capable of maintaining, transmitting, or storing, a vehicle’s telematics and driving data.


SYNOPSIS

This amendment clarifies that the disclosure of nonpublic personal information identified in subsection (c) is governed by 18 Del.Code., § 535 and 18 Admin. Code §§ 904-1.0 through 904-16.0.  This Amendment also inserts a definition for “data reporting device”.

With this amendment, this bill requires private passenger automobile policyholders to consent to the installation of any vehicle data reporting device, requires insurers to notify policyholders as to the data collected by such device and the impact on insurance premiums associated with the use and discontinuation of use of such device, provides that the collection of data obtained by such devices is subject to Delaware's privacy laws, and provides that any private passenger automobile rating plan that uses data obtained from a vehicle data-reporting device is subject to Delaware's rating law.
