DESCRIPTION: AN ACT TO AMEND TITLES 11 AND 21 OF THE DELAWARE CODE
RELATING TO TEMPORARY INSTRUCTION PERMITS AND DRIVERS LICENSES.

ASSUMPTIONS:
1.
Effective
upon signature of the Governor.
2.
This
Act creates a means for an undocumented immigrant to apply for and obtain valid
driving privileges in the State of Delaware.
Those who are eligible will be issued a Class D driver license for
driving privileges only and is not considered a valid form of identification
due to the applicant’s inability to prove legal presence in the United
States. The Driving Privilege Card will
be uniquely designed to distinguish it from other driver licenses. This Act does not change any existing driver
license requirements for those who are citizens of the United States or who
have lawful presence in the United States.

The
Delaware Department of Transportation estimates the fiscal impact of this Act
will be $317,652 for upfront costs and $112,652 for ongoing costs in order to
implement the Driving Privilege Card Program.
The upfront costs consist of $125,000 for vendor programing, $40,000 for
DelDOT IT programming, $102,652 for personnel costs and $50,000 for
education/community outreach for the first year. The ongoing costs consist of $102,652 for
personnel costs and $10,000 for education/community outreach that will be
required for one to two years beyond the initial year.

This
Act will also result in additional revenue.
The cost of the DPC is $20 and the Department estimates that there will
be 20,000 individuals taking advantage of the DPC Program, therefore generating
additional revenue of $400,000 within the first two years of the program. The revenues generated from the DPC will
offset a significant amount of the costs associated with implementing this
program for Delaware Department of Transportation.
5. The
Delaware State Police, State Bureau of Identification (SBI) would be
responsible for fingerprinting, fingerprint analysis and the criminal history
background check for every first-time applicant. In order to accomplish this, SBI will require
equipment to link Livescan workstations located at the four DMV’s to the
Automated Fingerprint Identification System (AFIS). The equipment and necessary programming will
cost $118,000 in one-time costs.
On-going maintenance will cost
$14,500. Signage and informational materials
in multiple languages are expected to cost approximately $2,000 annually.
6.
SBI also will require additional staffing
for at least the first several years.
These positions may be analyzed as the number of first-time applicants
dwindles, at which time the incumbents can be transferred into existing vacant
positions and the additional positions can be eliminated from SBI’s
compliment. First year costs are
calculated for 9-months, to allow for appropriate hiring and training time
prior to the proposed start time.
