AN ACT TO AMEND THE LAWS OF DELAWARE RELATING TO THE BOND AND CAPITAL IMPROVEMENTS ACT OF THE STATE OF DELAWARE AND CERTAIN OF ITS AUTHORITIES FOR THE FISCAL YEAR ENDING JUNE 30, 2016 AND SPECIFYING CERTAIN PROCEDURES, CONDITIONS AND LIMITATIONS FOR THE EXPENDITURES OF FUNDS OF THE JUDICIARY AND COMMUNITY TRANSPORTION FUND. |
Section 1. Notwithstanding any other provisions of the Delaware Code, Delaware Law or any other Act to the contrary, the Judiciary may expend from unencumbered balances in Account 02-00-00-30004 for preliminary costs associated with land acquisition, planning and design related to downstate Family Court facilities in Georgetown and Dover. The expenditure of said funds shall be pursuant to Section 35 of the Fiscal Year 2016 Bond and Capital Improvements Act (SS1 for Senate Bill 160 of the 148th General Assembly) or consistent with similar language in future bond and capital improvement acts.
Section 2. Notwithstanding any other provisions of the Delaware Code, Delaware Law or any other Act to the contrary, the Judiciary, in coordination with the Division of Facilities Management, Office of Management and Budget, may expend from unencumbered balances in Account 02-02-10-20325 to make capital investments to address the long-term space needs associated with the New Castle County Courthouse, specifically related to the appraisal and purchase of property in the City of Wilmington.
Section 3. Notwithstanding the provisions of 29 Del. C. to the contrary, the Delaware Department of Transportation is hereby authorized to use Community Transportation Funds for a one-time reimbursement to the Citizens Hose Company #1, Incorporated and David C. Harrison American Legion Post #14 in the amount of $30,000.00 each for sign improvement projects.
Section 4. Amend Section 24, Chapter 78, Volume 80 of the Laws of Delaware by making deletions as shown by strike through and insertions as shown by italicized double underline as follows:
Section 24. Jackson Street and H.
Fletcher Brown Boys and Girls Club Clubs. Of the
unencumbered balance in the prior fiscal year appropriations for the Community
Redevelopment Fund, $400,000 shall be allocated for the Jackson Street Boys and
Girls Club or for the H. Fletcher Brown Boys and Girls Club, or both, for
renovation project projects to be administered by the
Boys and Girls Club of Delaware. The Co-Chairs of the Joint Legislative
Committee on the Capital Improvement Program shall determine the source of
program funds to be allocated for said any renovation project under this
Section. Upon transfer of funds, the any renovation project under this
Section shall commence by September 15, 2015
SYNOPSIS
This Act authorizes the Judiciary to spend existing Appropriated Special Funds, collected by Family Court, for preliminary costs associated with the planning, design and land acquisition of downstate Family Court facilities. This funding would be expended pursuant to Section 35 of the Fiscal Year 2016 Bond and Capital Improvements Act. It also clarifies that the Judiciary is authorized to make capital investments for long-term space needs associated with the New Castle County Courthouse. Any procured property would belong to the State of Delaware. This Act authorizes the use of Community Transportation Funds for two sign improvement projects. Further, this Act amends the Fiscal Year 2016 Bond and Capital Improvements Act by authorizing the expenditure of prior year Community Redevelopment Funds for both the Jackson Street and H. Fletcher Brown Boys and Girls Clubs. The changes made to the Fiscal Year 2016 Bond and Capital Improvements Act by this Act are shown using strike through, to indicate existing language removed by this Act, and italicized double underline, to indicate new language added by this Act. |
