Long Title:AN ACT TO AMEND TITLE 29 OF THE DELAWARE CODE RELATING TO THE MERIT SYSTEM OF PERSONNEL ADMINISTRATION.
Synopsis:Section 82 of the Fiscal Year 2007 budget allowed for necessary mid-year adjustments to existing State human resource procedures as a result of the implementation of human resource information systems. This legislation makes corresponding amendments to Chapter 59 of Title 29 to make these changes permanent. Terminology is updated and modernized to reflect the new State hiring system.
Section 1 updates § 5904A, renames competitive examination to competitive recruitment and renames eligibility lists to referral lists. The posting of positions has been standardized to a minimum of seven days.
Section 2 updates § 5917 with regards to recruitment and examination requirements and procedures.
Section 3 and 4 update § 5918 with regards to procedures in promotions.
Section 5 renames eligibility lists to referral lists and revises the requirements of these lists as contained in §5919. The number of individuals on the previously referred to “eligibility list” has been simplified to a standard number of 30 and all tie-breakers have been eliminated to allow all with equal scores to be placed on the list.
Sections 6 and 7 rename examination to recruitment.
Section 8 updates § 5921 by increasing the number of qualified applicants to be considered, and by deleting requirements based on the size of an agency.
Section 9 renames examination to competition.
Section 10 ensures that all veterans, not just those who were Delaware residents at the time of their induction, will be granted additional points when obtaining initial State employment.
Section 11 clarifies rules for applying veterans’ preference in state hiring.
Sections 12 and 13 delete provisions in Code establishing procedures when two or more applicants are qualified for a state position.
