| Long Title: | AN ACT TO AMEND THE DELAWARE CODE RELATING TO PUBLIC HEALTH EMERGENCIES. |
| Synopsis: | Delaware has an in-state stockpile of medications stored at various locations throughout the state for the purpose of controlling a declared State of Emergency in which there is a public health threat such as pandemic flu or a bioterrorist attack.
Current Delaware laws allow the use of trained, non-licensed support personnel to assist with the dispensing of medications as long as a licensed healthcare professional is physically present to directly oversee the medication dispensing process.
The current law is a problem because, in the event of a declared State of Emergency in which there is a public health threat, there is no guarantee that there would be a sufficient number of licensed healthcare professionals who could oversee the medication dispensing process at locations where essential workers are employed. This is because licensed healthcare professionals would be primarily located at the mass dispensing sites to oversee medications given to the general public.
This Act would exempt licensed healthcare professionals as well as trained, non-licensed persons, acting at the direction of the Public Health Authority, from the licensing statutes and regulations for healthcare professionals. This exemption is necessary to allow trained, non-licensed persons to hand-out prepackaged medications to essential workers – Delaware’s first line of defense -- without there necessarily being a licensed healthcare professional physically present to oversee the dispensing process.
Trained, non-licensed persons include but are not limited to individuals from the Division of Public Health, the Delaware Emergency Management Agency, and DelDOT as well as fire service and law enforcement agencies.
