Long Title:AN ACT TO AMEND TITLE 26 OF THE DELAWARE CODE RELATING TO THE PUBLIC SERVICE COMMISSION AND CRITERIA FOR GRANTING CERTIFICATES OF PUBLIC CONVENIENCE AND NECESSITY TO WASTEWATER UTILITIES.
Synopsis:This legislation clarifies the changes that were intended to be made to § 203D(d) by Senate Bill No. 77, such subsection lists the various alternative means for a wastewater utility to obtain a certificate to provide its services in an area. The legislation is offered because Senate Bill No. 77 omitted one of the alternatives now being proposed. It attempts to remedy the omission but does so in a way that makes one of the stated alternative methods confusing. However, beyond such clarification, this legislation does make two additional changes beyond that proposed in Senate Bill No. 77. This legislation requires that when a utility seeks to provide service to an existing development or subdivision, it must provide notice of its application for a certificate to all the landowners in the development. Present law requires such notice when parcels are going to be “included” in the service territory without landowner consent. This continues that requirement. One purpose for such notice is to prevent the wastewater utility from obtaining a certificate by simply procuring the requisite number of petitions from some of the landowners without notifying the other landowners of its efforts to have the development brought within the utility’s service area. In addition, this amendment allows the Commission the discretionary authority to deny an application to service an existing development, subdivision or community if the Commission might find that such service to the community by the requesting utility would not serve the public interest.
