Long Title:AN ACT TO AMEND TITLE 25 OF THE DELAWARE CODE RELATING TO JURISDICTION OF THE JUSTICE OF THE PEACE COURT IN SUMMARY POSSESSION ACTIONS.
Synopsis:Currently, when more than one Justice of the Peace Court location hears civil cases in a given county, the law requires that landlord/tenant actions for summary possession be filed in the court closest to the premises or unit in question. This area is commonly referred to as the court location’s territorial jurisdiction. This legislation would replace the boundary created by geography with districts set by Court Rule for the purpose of establishing jurisdiction, thereby allowing the Court to better utilize the resources available to each Justice of the Peace Court location in handling its individual caseload.
