Long Title:AN ACT TO AMEND TITLE 7 OF THE DELAWARE CODE RELATED TO CERTAIN CRIMINAL PENALTIES.
Synopsis: Section 1 of this Act raises the minimum fine for first and subsequent violations of the rules and regulations for the Delaware State Parks system, as well as enhances the penalty for a violation of the surf fishing permit requirements for vehicles on Delaware designated beaches and for the failure to pay an entrance fee to any designated park. Section1 also reduces any potential term of imprisonment for a first offense from 30 to 10 days. Section 2 raises the minimum fine for a first offense of environmental laws and regulations from $50 to $100 and adds the cost of a permit into the fine, if the violation(s) included conducting an activity without the appropriate permit(s).
The remaining sections of the Act enhance and strengthen the State’s ability to prevent, punish and rectify illegal dumping and solid waste violations. The added rebuttable presumptions may be especially helpful in addressing sporadic or isolated instances of illegal dumping that adversely affect innocent landowners and detract from the State's natural beauty and resources. Landowners are provided a private cause of action for damages from solid waste illegally dumped on their properties.
