| Long Title: | AN ACT TO AMEND TITLE 21 OF THE DELAWARE CODE RELATING TO EQUIPMENT AND CONSTRUCTION VEHICLES. |
| Synopsis: | This Bill will establish that the use of engine exhaust braking systems shall be limited to emergency situations. Engine exhaust braking devices when deployed create excessive noise that is the frequent source of complaints. Under current Code, the use of these devices is allowed if the device is in good repair regardless of the condition in which it is being deployed. The current language has made the posting of signage along the highways difficult. This Bill clarifies the Code to establish strict use conditions for these devices and will enable clear signage to be posted at appropriate locations to ensure that the drivers of such vehicles are aware that jake brakes cannot be utilized except in case of emergency.
