Long Title:AN ACT TO AMEND THE MUNICIPAL CHARTER OF THE TOWN OF WYOMING (43 DEL. LAWS 189) TO AMEND THE DESIGNATION OF THE BOUNDARIES OF THE TOWN OF WYOMING; BRING THE ACT INTO COMPLIANCE WITH CHAPTER 75 OF TITLE 15 OF THE DELAWARE CODE; PERMIT TAXATION AND BORROWING BY THE TOWN OF WYOMING IN A MANNER CONSISTENT WITH THE GROWTH OF THE TOWN THROUGH ANNEXATION; AND MAKE OTHER MINOR CHANGES TO MAKE THE ACT CONSISTENT WITH THE PRACTICES OF THE TOWN OF WYOMING.
Synopsis:This Act amends the Town Charter of the Town of Wyoming by amending the designation of the Town boundaries from specific metes and bounds to the official records of the Recorder of Deeds for Kent County.
This Act also amends the Town Charter of the Town of Wyoming to be consistent with Chapter 75, Title 15 of the Delaware Code (Municipal Elections) as follows: modifying the qualification of candidates by disqualifying candidates with any felony convictions, requiring the filing of a Certificate of Intention or a Statement of Organization, amending the deadlines from 4:00 PM to 4:30 PM, allowing voting by absentee ballot and addressing changes to the appointment and functions of the Board of Election.
This Act also amend the Town Charter of the Town of Wyoming by changing the requirements of Council members-elect as regarding attendance at meetings of the Town Council between the date of the election and the swearing-in of the members-elect.
This Act also amends the Town Charter of the Town of Wyoming to indicate that the presiding officer of the Town Council shall be designated as Mayor rather than as President.
This Act also amends the Town Charter of the Town of Wyoming to permit assessments to be obtained from Kent County.
This Act also amends the Town Charter of the Town of Wyoming to permit tax collection up to $600,000 each year, or up to $1,000,000 each year if authorized by properly noticed and conducted referendum.
This Act also amends the Town Charter of the Town of Wyoming by deleting the section regarding the Board of Health.
This Act also amends the Town Charter of the Town of Wyoming to permit fines for violation of municipal ordinances or regulations to be not more than $5,000.
This Act also amends the Town Charter of the Town of Wyoming to permit borrowing by the Town Council of up to $125,000.
This Act also amends the Town Charter of the Town of Wyoming to permit reasonable impact fees to be imposed on new development, new construction or first time occupancy of new construction.
