| Long Title: | AN ACT TO AMEND TITLE 16 OF THE DELAWARE CODE RELATING TO ADVANCE HEALTH-CARE DIRECTIVES AND HEALTH-CARE INFORMATION. |
| Synopsis: | This Act enables an agent, surrogate or guardian of the person to have full authority and standing under the Health Insurance Portability and Accountability Act (“HIPAA”), its regulations and standards, to act as the personal representative under HIPAA, even if the advance health-care directive, surrogate confirmation or guardianship order does not so expressly provide. For example, the agent, surrogate or guardian of the person would qualify to obtain medical information about the declarant or disabled person that is protected under the privacy rules of HIPAA. This would help the agent, surrogate or guardian of the person make health-care decisions on behalf of the incapacitated declarant or disabled person.
