| Long Title: | AN ACT TO AMEND TITLE 21 OF THE DELAWARE CODE RELATING TO PENALTIES FOR OFF-HIGHWAY VEHICLE VIOLATIONS. |
| Synopsis: | This bill enhances the general penalty section for off-highway vehicle (OHV) violations. At present the penalty is a fine of not less than $11.50 nor more than $345, or impoundment of the OHV for 30 days, or both.
The new penalties include higher fines and periods of impoundment, along with a towing option.
For a first offense, the penalty is a fine of $100 and impoundment of the OHV at the time of conviction for up to 100 days.
For a subsequent offense that occurs within 24 months of a prior conviction of this chapter or a similar OHV state or local law, statute, or ordinance, the penalty is a fine of $400 and impoundment for a mandatory minimum time period of 6 months.
The penalties for §6821, operating an OHV on public or private property without permission or in violation of restrictions, have not been changed. However, the specific penalties for §§6811 and 6814 have been removed so that a violation of those sections will fall under the new general penalties section.
