Long Title:AN ACT TO AMEND TITLES 11, 28 AND 29 OF THE DELAWARE CODE RELATING TO BOXING.
Synopsis:This Act implements the recommendations of the 2003 Joint Sunset Committee.
In doing so, this Act strikes the existing provisions of Title 29 governing boxing and replaces them with language vesting general statutory authority to regulate Boxing and Combative Sports Entertainment in Delaware in the Division of Professional Regulation. This Act goes on to re-create Chapter 1 of Title 28 (Sports and Amusements) establishing:
General Provisions for regulating the industry of boxing and combative sports entertainment ;
The Powers and Duties of the Division;
Licensing, Registration, and Permitting provisions;
Provisions governing Applications, Bonding Requirements, and Exceptions;
A Boxing and Combative Sports Advisory Council; and
Disciplinary Procedures including the right to judicial review of the Division’s decisions and orders.
The new chapter established by this Act prohibits combative fighting (Toughman and Mixed Martial Arts (MMA) type events) but allows for combative sports entertainment events. Persons intending to participate in or promote any amateur or professional boxing or combative sports entertainment match, contest, or event in this State do so pursuant to Division regulations.
This Act creates two, new class A misdemeanors: “Unauthorized promotion of a boxing or of a combative sports entertainment or combative fighting match, contest, or event,” and, “Unauthorized participation in boxing or in a combative sports entertainment or combative fighting match, contest, or event.”
