Long Title:AN ACT TO AMEND TITLE 9 OF THE DELAWARE CODE RELATING TO THE LOCATION OF SEWER TREATMENT PLANTS AND OTHER SEWAGE DISPOSAL FACILITIES IN SUSSEX COUNTY.
Synopsis:This Bill eliminates the requirement, unique to Sussex County, that all sewer or water treatment plants constructed after April 18, 1990 or serving a sewer district created after January 1, 1991 must be located within the sewer or water district that they serve. Through this Bill, Sussex County, like Kent and New Castle County and private wastewater providers, will be able to construct wastewater treatment facilities in locations that are most suitable for such operations, without a limitation on placing them within a sewer district. It will allow Sussex County much more flexibility in obtaining land that is more suitable for such operations based on factors including neighboring and adjacent uses of the property, cost of acquiring the property, environmental considerations and suitability of soils.
