| Long Title: | AN ACT TO AMEND THE CHARTER OF THE TOWN OF ELLENDALE, RELATING TO THE TOWN ELECTION LAWS, ANNEXATION, RATE OF TAXATION, AMOUNT OF MONEY THAT CAN BE BORROWED AGAINST BONDS AND SHORT TERM BORROWING LIMITS. |
| Synopsis: | This Amendment to the municipal charter of the Town of Ellendale makes the charter consistent with the provisions of the state Municipal Election statute which provides: a twenty day notice of the date of the election; a seven day waiting period between the close of the election and the swearing in of newly elected officials; and designates the procedures for counting votes and publicizing the results of the election. This Amendment also removes the requirement that candidates for the Town Council be “taxables” of the Town. See Gebelein, ex rel. Wellwood v. Nashold, 406 A.2d 279 (Del.Ch. 1979). This Amendment also makes changes to four other sections of the charter by increasing the minimum acreage requirement which will trigger a special election as part of the annexation process to five contiguous acres, allowing the rate of taxation to be set at per $50.00 of assessed value, allowing borrowing by the Town of up to 25% of the assessed value of real property within the Town, and allowing short term borrowing by the Council without voter approval of up to $60,000.
