Long Title:AN ACT TO AMEND CHAPTERS 69 AND 80 TITLE 29 OF THE DELAWARE CODE RELATING TO THE ENERGY PERFORMANCE CONTRACTING ACT AND THE DELAWARE ENERGY ACT, RESPECTIVELY.
Synopsis: This Act amends Section 8059 of Title 29, which created Delaware’s Sustainable Energy Utility (“SEU”). The SEU is serving as a national model and has placed Delaware at the forefront of sustainable/green energy initiatives. The SEU intends to partner with the State, state agencies, local governments, and school districts to increase the energy efficiency of buildings and create other green energy initiatives that are designed to save the State, state agencies, local governments, and school districts substantial sums on energy costs, and also create a significant number of jobs within the State. Given the current budget problems confronting the State, these are vitally important goals. To help achieve these goals, this act will update and clarify Sections 6972, 6974, and 8059 of Title 29 of the Delaware Code related to the Energy Performance Contracting Act and the Delaware Energy Act to make clear that contracts involving the SEU to which the State, state agencies, local governments, or school districts are parties, do not create a tax supported obligation, bond, or note of the State, state agency, or local government. Therefore, the full faith and credit of the State will not be implicated by such contracts, even where the State or a state agency is a party.
