This Amendment facilitates clarity in the State's land records by making clear that, in addition to a register of wills: (1) A recorder of deeds may also adopt a form to be used by a beneficiary of a transfer on death deed to provide notice of the death of a transferor whose property has transferred to the beneficiary by transfer on death deed. (2) A beneficiary of a transfer on death deed may also present a transferor’s death certificate to a recorder of deeds for filing with a form adopted by the record of deeds or for filing to otherwise establish a transferor’s death.
