This Amendment does the following: (1) Requires a person who has submitted study or report on archaeological resources on the person’s land to the Director of the Division of Historical and Cultural Affairs (“Director”) to address the Director’s comments as part of the pre-application review process. (2) Requires a person to submit a study or report to the Director if the study or report been prepared after the pre-application review process but before the local jurisdiction has approved of the person’s proposed action. (3) Provides the Division of Historical and Cultural Affairs, with approval from the Department of State, with the authority to promulgate rules and regulations to implement this Act. (4) Makes technical corrections to the Act. (5) Makes clear that the Act does not apply to projects that have already been submitted for pre-application review as of the effective date of the Act.
