This Amendment clarifies that employees who have not been employed by their employers for at least ninety (90) consecutive days are not to be included under the definition of “covered person”. The Amendment also removes the requirement that covered employees who do not opt out are automatically enrolled in the Program, instead creating an affirmative duty for an employee to request enrollment to their Program administrator.
