This Amendment adds exceptions to the prohibition on political affiliation discrimination in employment practices. Specifically, this Amendment excludes the following: (1) Political activity during working hours, on the employer’s premises, or using the employer’s equipment that violates a content-neutral employment rule or policy. (2) An investigation against an employee because of a violation of state, local, or administrative law where the law concerns ethics, conflicts of interest, potential conflicts of interests, or the proper discharge of employee duties. This Amendment also makes technical corrections to conform the Act to the standards of the Delaware Legislative Drafting Manual.
