This Amendment clarifies that the 10 year period before a felony conviction is eligible for mandatory expungement is from the date of conviction or the date of release from incarceration, whichever is later. This is the same manner that the time period is determined for convictions that may be eligible for discretionary expungement under § 4374 of Title 11. This Amendment also removes burglary and felony theft from the offenses that are eligible for mandatory expungement.
