HB 96CommitteeMorrisonThis Act reduces the eligible age of a citizen to vote in school board elections for purposes of electing members to the school board from 18 years old to 16 years old. For all other public school elections, which includes referendums, the minimum voting age remains 18 years old. This Act also adds a driver education learner’s permit, Level 1 learner’s permit, and school transcript to the list of documents that may be presented to determine identification, and residence in the school district, in order to vote. This Act also makes technical corrections to conform existing law to the standards of the Delaware Legislative Drafting Manual. This Act will take effect January 1 after its enactment into law.AN ACT TO AMEND TITLE 14 OF THE DELAWARE CODE RELATING TO VOTING IN SCHOOL ELECTIONS.

HB 38 w/ SA 1SignedPostlesThis Act amends the Charter of the Town of Magnolia to update and clarify the authority of the Town to borrow money. Specifically, this Act increases the short-term borrowing limit from $15,000 to $50,000, which borrowings are to be authorized by a majority vote of the Town Council. This Act establishes procedures for the Town Council to borrow up to 15% of the assessed value of real property in the Town pursuant to a super-majority vote of the Town Council following a public hearing on the borrowing. The Town’s long-term debt limit pursuant to the favorable vote of the qualified voters is being increased from 15% to 25% of the total assessed value of real property in the Town. This Act clarifies that the owner of more than one lot in an unfinished subdivision may only vote once in a borrowing referendum. This Act makes various miscellaneous changes to internal references to establish consistency with the changes made herein.AN ACT TO AMEND THE TOWN CHARTER OF THE TOWN OF MAGNOLIA.
SB 34SignedLockmanOn March 1, 1875, the federal Civil Rights Act was enacted. Following the end of the Civil War and the adoption of the Thirteenth and Fourteenth Amendments, the goal of the Civil Rights Act of 1875 was to guarantee Blacks equal treatment in places of public accommodation and on public transportation. On March 25, 1875, the General Assembly enacted Chapter 194 of Volume 15 of the Laws of Delaware to permit places of public accommodation and public transportation to exclude individuals “whose presence there would be offensive to the major part of the proprietor’s customers and thereby injure the proprietor’s business”. Newspaper reports from the time indicate that this law was specifically designed to “neutralize the effects of” the Civil Rights Act of 1875. Almost 100 years later, in December 1963, the 122nd General Assembly enacted the Delaware Equal Accommodations Law, Chapter 45 of Title 6 of the Delaware Code, to prevent in places of public accommodations practices of discrimination against any person because of race, creed, color, or national origin. As part of this legislation, the 122nd General Assembly provided that “§ 1501 of Title 24, § 902 of Title 28, and § 703 of Title 26 of the Delaware Code of 1953, and all laws or parts of laws inconsistent with the provisions of this Act are hereby repealed insofar as such inconsistency does occur.” Despite the General Assembly’s intent, these provisions were not repealed at the time and, with the exception of § 703 of Title 26, which was repealed in 1974 with the rest of Chapter 7 of Title 26 as part of reorganization of Title 26, have continued to persist to this day. This Act explicitly repeals § 1501 of Title 24 and § 902 of Title 28, fulfilling the intent of the 122nd General Assembly that § 1501 of Title 24 and § 902 of Title 28 be repealed as inconsistent with the purposes of the Delaware Equal Accommodations Law that General Assembly adopted. This Act also serves to repudiate the State’s past involvement in racial discrimination that occurred in reliance on and under color of laws adopted by this State.AN ACT TO AMEND TITLE 24 AND TITLE 28 OF THE DELAWARE CODE RELATING TO PUBLIC ACCOMMODATIONS.

SA 1 to HB 38PassedBucksonThis Amendment makes technical corrections to House Bill No. 38 by revising references in Section 9 and 10 of the Town Charter of Magnolia (Charter) to correspond with revisions being made to Section 12 of the Charter by HB 38. This Amendment also makes the following technical corrections to HB 38 and the Charter to conform to the standards of the Delaware Legislative Drafting Manual: 1. Replaces “and/or” with “or” because in this context, “or” is inclusive and can mean 1 or more of the sections listed. Delaware Courts have stated that the use of “and/or” should always be avoided in statutes. (See Rule 10) 2. States numbers in the numerical form only. (See Rule 19(b)) 3. Expresses percentages with the percent symbol. (See Rule 19(f))
