AN ACT TO AMEND TITLE 11 OF THE DELAWARE CODE RELATING TO CONFIDENTIAL INFORMATION.
This bill amends the Address Confidentiality Act, Subchapter II of Chapter 96 of Title 11 of the Delaware Code, to extend the protections of the Department of Justice’s Address Confidentiality Program by prohibiting persons from publicly posting or displaying on the Internet, or soliciting, selling, or trading on the Internet, specified personal information of a program participant with the intent of inciting another person to imminently use the information to commit a crime involving violence or a threat of violence against, or to cause great bodily harm to, the program participant or any member of the program participant’s household. Additionally, this bill prohibits a person from publicly posting or displaying on the Internet specified personal information of a program participant if the participant (or a specified representative of the participant) has made a written demand on the person not to disclose the information. Finally, this bill provides that violations may be subject to criminal penalties as well as civil remedies for aggrieved persons.
