AN ACT AMENDING THE CITY OF NEWARK CHARTER, BEING CHAPTER 152 OF VOLUME 48, LAWS OF DELAWARE, RELATING TO ELECTIONS.

WHEREAS, the Charter currently requires that nominating petitions for Mayor and Council member candidates be filed at the Office of the City Secretary not later than the Monday which is 29 days before the election; and

WHEREAS, the City of Newark determined that changing this deadline would give the City Secretary’s office necessary additional time to take the steps required to prepare for an election; and

WHEREAS, the proposed two month deadline is consistent with the range of similar deadlines set forth in the Charters of other municipalities in Delaware,

NOW, THEREFORE:

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (Two-thirds of all members elected to each house thereof concurring therein):

Section 1: Amend Section 1001 of the Charter of the City of Newark by making insertions as shown by underlining and deletions as shown by strike through as follows:

Section 1001 -- Council Nominations. Nominations for mayor and councilmembers shall be by petition and there shall be no party designation on any such petition beside the name of any candidate or on any ballot in any municipal election. Each nomination petition shall be signed by the candidate and shall, in addition, bear the signatures of ten (10) qualified voters. The ten (10) qualified voters who sign a petition for mayor may be from the city at large, but the ten (10) qualified voters who sign a petition for councilmember must reside in the district from which the candidate seeks election. "Qualified voters," as used in this section, shall mean voters who are registered to vote in the election for which said petitions are filed at the time of the filing of the petition on which their names appear. The nominating petition for each candidate shall be filed at the office of the city secretary during normal business hours as provided for by ordinance not later than the Monday which is twenty-nine (29) days before the election The nominating petition for each candidate shall be filed at the office of the City Secretary during normal business hours as provided for by ordinance not later than the Monday which is between 60 and 66 days before the election .

Upon receipt of said petitions, they shall be checked forthwith by a member of the board of election for the validity of the names signed thereto.
