AN ACT TO AMEND THE CHARTER OF THE TOWN OF FRANKFORD RELATING TO EMPLOYEE BENEFITS.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (Two-thirds of all members elected to each house thereof concurring therein):

Section 1. Amend Section 18 of the Charter of the Town of Frankford by making insertions as shown by underlining and deletions as shown by strike through as follows:

Section 18. ENUMERATION OF POWERS

(A) Not by way of limitation upon the power vested in the Councilmen to exercise all powers delegated by this Charter to the municipal corporation of the Town of Frankford except as may expressly appear herein to the contrary, but, rather by way of eneumeration enumeration and for purposes of clarity, the Councilmen are vested by this Charter with the following powers, to be exercised by said Councilmen in the interest of good government and the safety, health, and welfare of the Town, its inhabitants and affairs, that is to say:

(42) To establish, by ordinance duly adopted in accordance with this Charter, a pension plan or a health and welfare plan, or both, for the employees of the Town under such terms and conditions as the Councilmen, in their discretion, deem most appropriate, provided, however, that any annual appropriation which is made by the Councilmen under any such pension plan or any health and welfare plan, or both, shall not exceed a maximum of Fifteen percent (15%) of the total annual payroll of the Town, and provided, further, that the method of funding may, if deemed advisable by the Councilmen, be accomplished through an insurance company licensed by the State of Delaware or authorized to do business in this State and approved by a majority of the Councilmen.
