HOUSE AMENDMENT NO. 1
AN ACT TO AMEND TITLE 21 OF THE DELAWARE CODE RELATED TO DRIVER LICENSE.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (Three-fifths of all members elected to each house thereof concurring therein):
Section 1. Amend § 2611(f), Title 21 of the Delaware Code by deleting each occurrence of the figure "5th" appearing therein and substituting in lieu thereof the word "eighth".
Section 2. Further amend § 2611(f), Title 21 of the Delaware Code by deleting the word "may" after the word "Secretary" and substituting in lieu thereof the word "shall", and further by deleting the phrase "less than 5 years" after the phrase "hazardous materials for a period of" and substituting in lieu thereof the phrase "5 years or less".
Section 3. Amend § 2611(h)(1), Title 21 of the Delaware Code by deleting the existing subsection in its entirety and substituting in lieu thereof the following:
"(1) The fee for a commercial motor vehicle driver license shall be $48 except when the commercial motor vehicle driver license is endorsed for the transport of hazardous materials in which event the fee shall be $30. The fee for a non-CDL Class A or non-CDL Class B driver license shall be $40.".
Section 4. Amend § 2611(h)(2), Title 21 of the Delaware Code by deleting the first sentence in subsection (2) and substituting in lieu thereof the following:
"The fee for renewal of a commercial motor vehicle driver license shall be $48 except when the commercial motor vehicle driver license is endorsed for the transport of hazardous materials in which event the fee shall be $30. The fee for renewal of a non-CDL Class A or non-CDL Class B driver license shall be $40.".
Section 5. Amend § 2703(a), Title 21 of the Delaware Code by deleting each occurrence of the phrase "60 days" appearing therein and substituting in lieu thereof the phrase "6 months", and further by deleting each occurrence of the phrase "60-day" appearing therein and substituting in lieu thereof the phrase "6-month".
Section 6. Further amend § 2703(a), Title 21 of the Delaware Code by deleting the figure "$2.00" appearing therein and substituting in lieu thereof the figure "$5".
Section 7. Amend §2703(b), Title 20 of the Delaware Code by deleting the existing subsection and substituting in lieu thereof the following:
"(b) The initial and subsequent renewal fee for an authorization or endorsement under this section shall be $8 when the authorization or endorsement holder also holds a commercial motor vehicle driver license endorsed for the transport of hazardous materials. Otherwise, the fee for an initial authorization or endorsement under this section and each renewal shall be $12.".
Section 8. Amend § 2710(g), Title 21 of the Delaware Code by deleting the figure "$25" appearing therein and substituting in lieu thereof the figure "$40".
Section 9. Amend § 2712(a), Title 21 of the Delaware Code by deleting the phrase "60-day" appearing therein and substituting in lieu thereof the phrase "6-month".
Section 10. Amend § 2712(b), Title 21 of the Delaware Code by deleting each occurrence of the phrase "60-day" appearing therein and substituting in lieu thereof the phrase "6-month", and further by deleting the phrase "60 days" appearing therein and substituting in lieu thereof the phrase "6 months".
Section 11. Further amend § 2712(b), Title 21 of the Delaware Code by deleting the figure "$2" appearing therein and substituting in lieu thereof the figure "$5".
Section 12. Amend § 2715, Title 21 of the Delaware Code by deleting the figure "5" in the section title and replacing it with the figure "8".
Section 13. Amend § 2715(a), Title 21 of the Delaware Code by deleting the figure "$25" appearing therein and substituting in lieu thereof the figure "$40".
Section 14. Further amend § 2715(a), Title 21 of the Delaware Code by deleting each occurrence of the word "fifth" appearing therein and substituting in lieu thereof the word "eighth", and further by deleting the phrase "5-year" appearing therein and substituting in lieu thereof the phrase "8-year".
Section 15. Amend § 2715(d), Title 21 of the Delaware Code by deleting the existing subsection in its entirety and substituting in lieu thereof the following:
"(d) Notwithstanding subsections (a), (b), and (c) of this section, the Secretary may issue driver licenses for less than 8 years during the first 5 years after this law is enacted so the number of renewals can be more evenly distributed over an 8-year period. If a driver license is issued for less than 8 years pursuant to this section, the fee shall be calculated at $5 per year.".
Section 16. Amend § 2716(b), Title 21 of the Delaware Code by deleting the figure "$15" appearing therein and substituting in lieu thereof the figure "$24".
Section 17. Further Amend § 2716(b), Title 21 of the Delaware Code by deleting the figure "5" before the word "years" and substituting in lieu thereof the figure "8".
Section 18. Amend § 2716(d), Title 21 of the Delaware Code by deleting the existing subsection in its entirety and renaming the current subsections (e) and (f) as subsections (d) and (e), respectively.
Section 19. This Act shall go into effect 240 days after the date of enactment.
