SENATE AMENDMENT NO. 1
AN ACT TO AMEND TITLE 9 OF THE DELAWARE CODE RELATING TO THE COMPOSITION OF THE NEW CASTLE COUNTY BOARD OF ASSESSMENT REVIEW.
WHEREAS, in 2004 New Castle County Council was expanded from seven (7) to thirteen (13) representatives; and
WHEREAS, the districts from which members of the Board of Assessment Review are selected need to reflect such expansion.
NOW, THERFORE:
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:
Section 1. Amend §1317, Title 9 of the Delaware Code by deleting "1 through 6" in the third sentence and substituting in lieu thereof "1 or 7, 2 or 8, 3 or 9, 4 or 10, 5 or 11, or 6 or 12".
Section 2. Amend subsection (a) of §1319, Title 9 of the Delaware Code by deleting "1 through 6" in the third sentence and substituting in lieu thereof "not represented on the Board pursuant to §1317 of this Chapter".
Section 3. If any provision of this Act or the application thereof to any person, thing or circumstances, is held invalid, such invalidity shall not affect the provisions of this Act that can be given effect without the invalid provisions or application, and to this end the provisions of this Act are declared to be severable.
