AN ACT TO AMEND TITLE 10 OF THE DELAWARE CODE RELATING TO JUDICIAL LAW CLERKS.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1. Amend Title 10 of the Delaware Code to add the following new Section 129:

"§ 129. Law Clerks.

Law clerks hold major, non-tenured advisory positions for the Justices of the Court. The Supreme Court may appoint and remove at pleasure such judicial law clerks as shall be necessary for the proper operation of the Court."

Section 2. Amend Title 10 of the Delaware Code to strike existing Section 329 and replace it with the following new Section 329:

"§ 329. Law Clerks.

Law clerks hold major, non-tenured advisory positions for the Chancellor and Vice-Chancellors of the Court. The Court of Chancery may appoint and remove at pleasure such judicial law clerks as shall be necessary for the proper operation of the Court."

Section 3. Amend Title 10 of the Delaware Code to strike existing Section 523 and replace it with the following new Section 523:

"§ 523. Law Clerks.

Law clerks hold major, non-tenured advisory positions for the Judges of the Court. The Superior Court may appoint and remove at pleasure such judicial law clerks as shall be necessary for the proper operation of the Court."

Section 4. Amend Title 10 of the Delaware Code to add the following new Section 916:

"§ 916. Law Clerks.

Law clerks hold major, non-tenured advisory positions for the Judges of the Court. The Family Court may appoint and remove at pleasure such judicial law clerks as shall be necessary for the proper operation of the Court."

Section 5. Amend Title 10 of the Delaware Code to add the following new Section 1310:

"§ 1310. Law Clerks.

Law clerks hold major, non-tenured advisory positions for the Judges of the Court. The Court of Common Pleas may appoint and remove at pleasure such judicial law clerks as shall be necessary for the proper operation of the Court."
