AN ACT TO AMEND TITLE 10 OF THE DELAWARE CODE RELATING TO BAILIFFS AND JUDICIAL ASSISTANTS.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1. Amend §522(b), Title 10 of the Delaware Code by: (1) deleting "countywide jurisdiction in the county of their employment; and who shall have", (2) inserting after the word "case" and before the ".", "provided that the exercise of such powers shall be limited to any building or real property maintained or used as a courthouse or in support of judicial functions.", and (3) by deleting "The order appointing such peace officers shall be recorded in the office of the recorder of deeds in and for the county where they are employed in the same manner as gubernatorial commissions."

Section 2. Amend §908(9), Title 10 of the Delaware Code by deleting ", shall possess all powers incident to such office including, without limitation, the power to make arrests in criminal matters, all such powers being exercisable anywhere in the county of their employment." and substituting in lieu thereof "shall have such powers normally incident to peace officers, including but not limited to, the power to make arrests in a criminal cases, provided that the exercise of such powers shall be limited to any building or real property maintained or used as a courthouse or in support of judicial functions."

Section 3. Amend §1314A(b), Title 10 of the Delaware Code by deleting "countywide jurisdiction in the county of their employment, and who shall have".
