AN ACT TO AMEND TITLES 11, 16, 18 AND 29 OF THE DELAWARE CODE RELATING TO THE OFFICE OF NARCOTICS AND DANGEROUS DRUGS AND THE DELAWARE STATE POLICE DRUG DIVERSION UNIT.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:
Section 1. Amend §8206, Title 29, of the Delaware Code by adding "(a)" before the phrase "The Division of State Police is established".
Section 2. Amend §8206, Title 29 of the Delaware Code by adding a new subsection (b) to state as follows:
"(b) Notwithstanding any law to the contrary, the Office of Narcotics and Dangerous Drugs shall be transferred to the Delaware State Police as part of the division’s criminal investigations unit and shall be renamed the "Delaware State Police Drug Diversion Unit."
Section 3. Amend §1911(a)(9), Title 11, of the Delaware Code by deleting the phrase "State Office of Narcotics and Dangerous Drugs" and replacing it with the phrase "State Police Drug Diversion Unit".
Section 4. Amend §8401(5)a. of Title 11 of the Delaware Code by deleting the phrase "State Office of Narcotics and Dangerous Drugs" and replacing it with the phrase "State Police Drug Diversion Unit".
Section 5. Amend §9200(b) of Title 11 of the Delaware Code by deleting the phrase "State Office of Narcotics and Dangerous Drugs" and replacing it with the phrase "State Police Drug Diversion Unit".
Section 6. Amend §4797 of Title 16 by deleting the phrase "Office of Narcotics and Dangerous Drugs" and replacing it with the phrase "State Police Drug Diversion Unit".
Section 7. Amend §5172(a) of Title 16 of the Delaware Code by deleting the phrase "State Office of narcotics and Dangerous Drugs" and replacing it with the phrase "State Police Drug Diversion Unit".
Section 8. Amend §6601(1) l. of Title 18 of the Delaware Code by deleting the phrase "State Office of Narcotics and Dangerous Drugs" and replacing it with the phrase "State Police Drug Diversion Unit".
