AN ACT TO AUTHORIZE AND APPROVE THE TRANSFER OF CERTAIN REAL PROPERTY INTERESTS IN THE TOWN OF MIDDLETOWN, NEW CASTLE COUNTY, TO THE TOWN OF MIDDLETOWN.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

WHEREAS, the Town of Middletown is a Delaware municipality; and

WHEREAS, the Delaware National Guard will vacate the William Nelson Armory located in the Town of Middletown and relocate operations to the Newark area; and

WHEREAS, the Delaware National Guard will no longer have a use or need for this specific armory; and

WHEREAS, the General Assembly finds and declares that it would be in the best interest of the citizens of Delaware and of the parties involved to transfer said building and property to the Town of Middletown in fee simple; and

WHEREAS, the Town of Middletown wishes to make the facility available to the American Legion Post 25 and to the Appoquinimink Boys and Girls Club.

NOW THEREFORE:

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (Three-fourths of all members elected to each house thereof concurring therein):

Section 1. The transfer and conveyance of all property interests in that certain parcel of land and all structures situated thereof, known as the William Nelson Armory to the Town of Middletown for the consideration of one dollar ($1.00), is hereby specifically approved, notwithstanding (1) any provisions of Chapter 94, Title 29 of the Delaware Code; or (2) any provisions of any other laws or regulations to the contrary.

Section 2. The Office of Management and Budget, Division of Facilities Management, or other appropriate State agency, is hereby authorized and empowered to execute and deliver to the Town of Middletown a good and sufficient deed to transfer all property interests in said real property.

Section 3. The Town of Middletown agrees to accept the property in "as is" condition at the time of conveyance.

Section 4. The provisions of this Act shall be effective upon the vacating of the William Nelson Armory by the Delaware National Guard.
