AN ACT TO AMEND TITLE 10 OF THE DELAWARE CODE RELATING TO PROCEDURES APPLICABLE TO TRESPASS, REPLEVIN, AND DETINUE CLAIMS IN THE JUSTICE OF THE PEACE COURT.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:
Section 1. Amend Chapter 95 of Title 10 of the Delaware Code by deleting § 9612 as it appears in that chapter in its entirety and substituting in lieu thereof the following:
"§ 9612. Form of Summons.
The summons under this subchapter shall be in the form provided by the Justice of the Peace Court for summons in civil cases."
Section 2. Amend Chapter 95 of Title 10 of the Delaware Code by deleting § 9613 as it appears in that chapter in its entirety.
Section 3. Amend § 9614 of Title 10 of the Delaware Code by deleting the phrase "upon the land of persons, other than the owners, of animals, fowl or chattels," as it appears in that section in its entirety.
Section 4. Amend Chapter 95 of Title 10 of the Delaware Code by deleting § 9615 as it appears in that chapter in its entirety.
Section 5. Amend Chapter 95 of Title 10 of the Delaware Code by deleting § 9635 as it appears in that chapter in its entirety.
Section 6. Amend Chapter 95 of Title 10 of the Delaware Code by deleting § 9636 as it appears in that chapter in its entirety.
