SENATE AMENDMENT NO. 1

AN ACT TO AMEND TITLE 31 OF THE DELAWARE CODE RELATING TO THE INTERSTATE COMPACT FOR THE PLACEMENT OF CHILDREN.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1. Amend Title 31, Chapter 3, Subchapter VI, §381, Article II(D), Delaware Code by deleting the word "sworn" as it appears therein and by substituting in lieu thereof the word "swear".

Section 2. Amend Title 31, Chapter 3, Subchapter VI, §381, Article III(B)(5)(c), Delaware Code by deleting the phrase "over the child’s case" as it appears therein and by substituting in lieu thereof the phrase "in interstate placements in which the public child placing agency is a party to the proceeding".

Section 3. Amend Title 31, Chapter 3, Subchapter VI, §381, Article IV(A), Delaware Code by deleting "Section G" as it appears therein and by substituting in lieu thereof "Section H".

Section 4. Amend Title 31, Chapter 3, Subchapter VI, §381, Article IV, Delaware Code by inserting a new paragraph C. to read as follows and relettering the existing paragraphs C., D., E., F., G., and H. as "D.", "E.", "F.,", G.", "H." and "I.", respectively:

"C. In cases that are before courts and subject to this compact, the taking of testimony for hearings before any judicial officer may occur in person or by telephone, audio-video conference, or such other means as approved by the rules of the Interstate Commission; and Judicial officers may communicate with other judicial officers and persons involved in the interstate process as may be permitted by their Canons of Judicial Conduct and any rules promulgated by the Interstate Commission."

Section 5. Amend Title 31, Chapter 3, Subchapter VI, Delaware Code by deleting from the headings and text in Subchapter VI, the phrases "Interstate Compact on the Placement of Children", and by substituting in lieu thereof the phrase "Interstate Compact for the Placement of Children" at each location found therein.
