AN ACT TO AMEND VOLUME 65, CHAPTER 295, LAWS OF DELAWARE, ENTITLED CHARTER OF THE TOWN OF BETHANY BEACH, REGARDING PENALTIES FOR VIOLATIONS OF TOWN ORDINANCES, TO INCREASE THE MAXIMUM FINANCIAL PENALTY THAT MAY BE IMPOSED TO ELIMINATE IMPRISONMENT AS A POTENTIAL SANCTION, AND TO AUTHORIZE THE TOWN TO IMPOSE CIVIL PENALTIES AS WELL AS CRIMINAL PENALTIES.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (Two-thirds of all members elected to each house thereof concurring therein):
WHEREAS, it is deemed advisable that the Charter of the Town of Bethany Beach, contained in Volume 65, Chapter 295, Laws of Delaware, entitled "Charter of the Town of Bethany Beach", as thereafter amended, be amended with regard to penalties for violations of Town of Bethany Beach ordinances to increase the maximum financial penalty that may be imposed, to eliminate imprisonment as a possible sanction for violations, and to authorize the Town to seek the imposition of civil penalties in lieu of criminal penalties;
NOW THEREFORE:
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (Two-thirds of all members elected to each house thereof concurring therein):
Section 1. Amend Section 4.2.31 of Volume 65, Chapter 295, Laws of Delaware by striking the same in its entirety and substituting in lieu thereof the following:
"4.2.31 May provide for the punishment of a violation of any ordinance of the Town by the imposition of a civil penalty or a criminal fine, not exceeding $1,500.00 for each offense.".
