AN ACT TO AUTHORIZE AND APPROVE THE TRANSFER OF CERTAIN REAL PROPERTY IN THE CITY OF HARRINGTON, KENT COUNTY, TO THE CITY OF HARRINGTON
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (Three-fourths of all members elected to each house thereof concurring therein):
WHEREAS, the City of Harrington is a Delaware municipality; and
WHEREAS, the City of Harrington has a need for certain real property for recreational and other municipal-government activities; and
WHEREAS, the City of Harrington and the Delaware National Guard in the public’s interest have for sometime been working together and allowing the City to conduct recreation programs at the armory; and
WHEREAS, the Delaware National Guard no longer has a use or need for this specific armory; and
WHEREAS, the City of Harrington wishes to fully utilize the Harrington armory property for the benefit of the citizens of the City; and
WHEREAS, the General Assembly finds and declares that it would be in the best interest of the citizens of Delaware and of the parties involved to transfer said building and property to the City of Harrington in fee simple.
NOW THEREFORE:
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (Three-fourths of all members elected to each house thereof concurring therein):
Section 1. The transfer and conveyance of that certain parcel of land and all structures situated thereof, located at 114 East Liberty Street, Harrington, Kent County, Delaware (tax parcel id 170.20-04-66.00) to the City of Harrington for the consideration of one dollar ($1.00), is hereby specifically approved, notwithstanding (1) any provisions of Chapter 94, Title 29 of the Delaware Code; or (2) any provisions of any other laws or regulations to the contrary.
Section 2. The Department of Administrative Services, or other appropriate State agency, is hereby authorized and empowered to execute and deliver to the City of Harrington a good and sufficient deed to the said real property.
Section 3. The City of Harrington agrees to accept the property in “as is” condition at the time of conveyance.
Section 4. The deed to the aforesaid real property shall contain a provision whereby said property will revert to the State of Delaware in the event that the property ceases to be used by the City of Harrington.
