AN ACT TO AMEND TITLE 21 OF THE DELAWARE CODE RELATING TO MOTOR VEHICLES.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE :

Section 1. Amend §2621, Title 21, Delaware Code, by adding a new paragraph (5) to subsection (a), to read as follows:

“(5) Emergency Mobile Communication Units operated in relation to a County Emergency Communication Center, the State Police, or any Municipality.”

Section 2. Amend § 2621, Title 21 of the Delaware Code, by adding a new paragraph (6) to subsection (a), to read as follows:

“(6) Any other emergency vehicle, as defined by § 4106(e), Title 21 of the Delaware Code, used in the preservation of life or property or in the execution of emergency governmental functions and are equipped with audible and visual signals and are not subject to normal traffic regulation.”

Section 3. Amend § 2621(b), Title 21 of the Delaware Code, by deleting ‘(1) and (2)’ after the word “paragraphs” in the first sentence and substituting in lieu thereof ‘(1), (2), (5), and (6)’.

Section 4. Amend § 2702(e)(9), Title 21 of the Delaware Code, by striking the entire paragraph (9) and substituting in lieu thereof the following:

‘(9) Non-CDL Class A or non-CDL Class B license. -- Authorizes the holder to operate farm vehicles, fire fighting equipment, and other authorized emergency vehicles under the commercial driver license waivers defined in § 2621 of this title .’

Section 5. Amend § 2621(b), Title 21 of the Delaware Code, by adding a second sentence following the first sentence to read as follows:

“Those drivers holding non-CDL Class A or non-CDL Class B licenses are limited to operating commercial motor vehicles within the State of Delaware unless there is a reciprocity agreement with adjoining states.”
