AN ACT TO AMEND TITLE 11 OF THE DELAWARE CODE RELATING TO COMPENSATION FOR INNOCENT VICTIMS OF CRIME.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:
Section 1. Amend § 9002(3), Title 11 of the Delaware Code by inserting the phrase “or any other sexual assault or sexual abuse” between the words “rape” and “manslaughter”.
Section 2. Amend § 9005(7), Title 11 of the Delaware Code by deleting the period ‘.’ at the end of the sentence and inserting in lieu thereof the following phrase “, except in cases of child sexual abuse of a minor by an adult.”.
Section 3. Amend § 9005, Title 11 of the Delaware Code by adding new paragraph ‘(9)’ to read as follows:
“(9) Notwithstanding any provision to the contrary, the Board shall not limit acceptance or consideration of any applications arising from sexual assault or abuse of a minor by an adult which may have otherwise been barred from consideration by a statute of limitations. “
Section 4. Amend § 9006, Title 11 of the Delaware Code by adding a new subsection ‘(d)’ to read as follows:
“(d) In no event shall the Board deny any claim solely because the applicant was a child victim of sexual assault or abuse by an adult, and said applicant either delayed reporting the abuse or assault to authorities or said applicant delayed an application for services to mitigate the effects of the impact of sexual assault or abuse by an adult.”.
Section 5. This Act shall become effective thirty (30) days following the enactment of this law.
