AN ACT TO AMEND TITLE 18 OF THE DELAWARE CODE RELATING TO COLORECTAL CANCER SCREENING.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE :
Section 1. Amend §3346(b), Title 18 of the Delaware Code by adding to subsection (b) a new paragraph to read:
"(3) For all persons covered pursuant to (1) or (2) of this subsection, colorectal cancer screening shall include the use of anesthetic agents, including general anesthesia, in connection with colonoscopies and endoscopies performed in accordance with generally-accepted standards of medical practice and all applicable patient safety laws and regulations, if the use of such anesthetic agents is medically necessary in the judgment of the treating physician.".
Section 2. Amend §3562(b), Title 18 of the Delaware Code by adding to subsection (b) a new paragraph to read:
"(3) For all persons covered pursuant to (1) or (2) of this subsection, colorectal cancer screening shall include the use of anesthetic agents, including general anesthesia, in connection with colonoscopies and endoscopies performed in accordance with generally-accepted standards of medical practice and all applicable patient safety laws and regulations, if the use of such anesthetic agents is medically necessary in the judgment of the treating physician.".
