AN ACT PERMITTING THE COLONIAL SCHOOL DISTRICT TO CONVEY TO THE CITY OF WILMINGTON THE BUILDING AT 3000 NORTH CLAYMONT STREET, WILMINGTON, DELAWARE.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (Three-fourths of all members elected to each house thereof concurring therein):
WHEREAS, the Colonial School District holds title to the building and land located at 3000 North Claymont Street (the “King Property”); and
WHEREAS, the State of Delaware has a 60% interest in the King Property and Colonial School District has a 40% interest in the King Property; and
WHEREAS, Colonial School District has no intention of using the King Property for school purposes, and the City of Wilmington plans to use the King Property for purposes beneficial to the residents of the City of Wilmington; and
WHEREAS, Colonial School District is willing to convey the King Property to the City of Wilmington, but Colonial School District is prohibited from doing so by 14 Del.C. § 1057.
NOW THEREFORE:
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (Three-fourths of all members elected to each house thereof concurring therein):
Section 1057 of Title 14 of the Delaware Code notwithstanding, Colonial School District may convey the King Property to the City of Wilmington. This conveyance shall be “as is” in that the City of Wilmington shall accept the building and land in their present condition.
