AN ACT TO AMEND CHAPTER 167, VOLUME 37, LAWS OF DELAWARE, ENTITLED "AN ACT TO INCORPORATE THE TOWN OF SLAUGHTER BEACH."

Be it enacted by the General Assembly of the State of Delaware (two-thirds of all members elected to each House thereof concurring therein):

Section 1. Amend Chapter 167, Volume 37, Laws of Delaware, by striking the word "President" wherever it appears in said chapter and substituting in lieu thereof the word "Mayor".

Section 2. Amend Section 3, Chapter 167, Volume 37, Laws of Delaware by striking the following:

"Each qualified elector shall have one vote for each dollar or fraction thereof of tax paid by him or her to the Collector of the Town of Slaughter Beach in the year in which said. election is held. The Collector of the Town of Slaughter Beach shall be presented with the assessment of the Town and the record of taxes paid". No voter shall cast his ballot or ballots until the Collector has determined the amount of his or her tax and whether or not said tax has been paid for the year in which the election is held. In the absence of disability of the Collector the Town Commissioners shall select some other suitable person to use the Collector's books and accounts as aforesaid", and substituting in lieu thereof the following:

"Every person eighteen years of age or upwards, who is duly registered upon the books of registered voters for said election district and who is a resident of the Town, shall be entitled to one vote at any election held within the Town."

Section 3. Amend Section 3, Chapter 167, Volume 37, Laws of Delaware by striking the following sentence:

"Residents of the Town who have lived therein for at least nine months preceding the election who are not qualified as aforesaid, but who have paid any poll or capitation tax assessed against them shall be entitlted to one vote".

Section 4. Amend Section 4 of Chapter 167, Volume 37. Laws of Delaware by striking the paragraph entitled "Regular Meetings of the Town Commissioner" in its entirety and substituting in lieu thereof:

"Meetings of Town Commissioners

Following the annual organization meeting, the Council shall thereafter hold meetings at such times as may be prescribed by ordinance of statute, but not less frequently than once each month."

Section 5. Amend Section 4 of Chapter 167, Volume 37, Laws of Delaware by striking the paragraph entitled "Special Meetings" in its entirety and substituting in lieu thereof:

"Special Meetings

Special Meetings of the Council may be called by the Mayor, and shall be called by the Mayor, upon written request of three members of Council, and all meetings, regular or special, shall be open to the public".

Section 6. Amend Chapter 167, Volume 37, Laws of Delaware by striking the words "Town Collector" whenever it is used in said chapter and substituting in lieu thereof the words "Town Tax Collector".

Section 7. Amend Chapter 167, Volume 37, Laws of Delaware by striking the word "Constables" whenever it is used in said chapter and substituting in lieu thereof the words "Police Department".

Section 8. Amend the third paragraph of the section entitled "Treasurer" of Section 6 of Chapter 167, Volume 37, Laws of Delaware by striking the words "Four Thousand Dollars ($4,000.00) "as they appear between "penal sum of" and "conditioned for the" and substitute in lieu thereof: "Five Thousand Dollars ($5,000.00)".

Section 9. Amend Section 7 of Chapter 167, Volume 37, Laws of Delaware by striking the following words: "The sum shall in no year exceed Five Thousand Dollars ($5,000.00) clear of all delinquencies and expenses of collection".

Section 10. Amend Section 8 of Chapter 167, Volume 37, Laws of Delaware by striking the sentence "The fiscal year of the said Town shall begin the first day of January in each year and shall end with the next succeeding thirty-first day of December" and substituting in lieu thereof: "The fiscal year of the said Town shall begin the first day of July in each year and shall end with the next succeeding thirtieth day of June."

Section 11. Amend Section 11 of Chapter 167, Volume 37, Laws of Delaware by striking said section in its entirety and substituting in lieu thereof the following:

"Section 11. Roads

The State Road known as Bay Avenue, which has been constructed just west and to the rear of the principal row of cottages in the Town of Slaughter Beach shall remain under the care of the Division of Highways, State of Delaware, and be maintained and repaired by the said Division of Highways."
