AN ACT TO AMEND CHAPTER 334 OF VOLUME 72, LAWS OF DELAWARE, ENTITLED "AN ACT TO AMEND TITLE 24 OF THE DELAWARE CODE RELATING TO AN INTERSTATE NURSE LICENSURE COMPACT", AND CHAPTER 19A OF TITLE 24 OF THE DELAWARE CODE TO EXTEND THE STATE'S PARTICIPATION IN THE INTERSTATE COMPACT.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE :
WHEREAS, the140th General Assembly of the State of Delaware enacted and the Governor signed into law on June 23, 2000 an Act (House Bill No. 439, as amended by Senate Amendments Nos. 1 and 2) entering into the Interstate Nurse Licensure Compact; and
WHEREAS, Section 5 of the legislation provides as follows: “This State’s participation in the Interstate Nurse Licensure Compact shall terminate on June 30, 2005 unless prior to that date this Section is amended to extend the State’s participation.”; and
WHEREAS, the operation of the Compact has facilitated the ability of nurses to practice their profession between and among Compact States and it is the intent of the General Assembly to extend indefinitely this State’s participation in the Interstate Nurse Licensure Compact.
NOW THEREFORE:
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:
Section 1. Amend Section 5 of Chapter 334, Volume 72, Laws of Delaware, by striking the final sentence of the Section and inserting a new sentence to read as follows:
“This Compact and this State’s participation therein shall remain in full force and effect beyond June 30, 2005 and shall not terminate without further action of the General Assembly.”.
Section 2. Amend Chapter 19A, Title 24 of the Delaware Code by adding thereto a new Section to read as follows:
Ҥ 1905A. Continuation of Compact.
This Compact and this State’s participation therein shall remain in full force and effect beyond June 30, 2005 and shall not terminate without further action of the General Assembly.”.
