AN ACT TO AMEND TITLE 11 OF THE DELAWARE CODE RELATING TO STATE POLICE.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE :
Section 1. Amend § 8372 of Title 11 of the Delaware Code by renaming paragraphs (b) and (c) as paragraph (c) and (d) respectively.
Section 2. Further amend § 8372 of Title 11 of the Delaware Code by adding a new paragraph (b) as follows:
"(b) Upon the death of a member in service, whose death occurred in the line of duty, a monthly survivor's pension shall be payable to the primary survivor equal to three-quarters of the member's compensation.".
Section 3. The State Office of Pensions shall pay benefits retroactively under this Act for the benefit of any primary survivor of a member who died in the line of duty on or after July 1, 2004. With respect to the primary survivor of any member who died in service prior to July 1, 2004, the State Office of Pensions shall make no payment of retroactive benefits, but shall commence payment of benefits provided for in the Act to eligible survivors with the next monthly pension payment after this Act is adopted into law.".
