AN ACT TO AMEND TITLE 11 AND TITLE 16 OF THE DELAWARE CODE TO BRING PERIODS OF PROBATION FOR FIRST OFFENDERS INTO CONFORMITY WITH SENATE BILL 50.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE :
Section 1. Amend §6712(d)(1), Title 11 of the Delaware Code by deleting the words “not less than 2 and one-half years” and by substituting in lieu thereof the words “one and one-half years”.
Section 2. Amend §4764(b) and (c), Title 16 of the Delaware Code by deleting the words “3 years” and by substituting in lieu thereof the words “one and one-half years”.
Section 3. Upon the enactment of this statute, anyone serving a first offenders’ program under either §6712(d)(1) or §4764 may petition the court to have the ordered probationary period reduced to one and one-half years pursuant to this statute.
Section 4. This Act shall become effective upon its enactment into law.
