AN ACT TO AMEND CHAPTER 170, VOLUME 57, LAWS OF DELAWARE, AS AMENDED, ENTITLED "AN ACT TO REINCORPORATE THE CITY OF LEWES", RELATING TO THE CITY MANAGER AND THE POLICE FORCE.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (Two-thirds of all members elected to each house thereof concurring therein):

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (Two-thirds of all members elected to each house thereof concurring therein):

Section 1. Amend the Charter of the City of Lewes, Chapter 170, Volume 57, Laws of Delaware, as amended, Section 19. CITY MANAGER, by striking said section in its entirety and substituting in lieu thereof the following:

“Section 19. CITY MANAGER

(a). The Mayor, by and with the advice and consent of a majority of all the members of the City Council, may appoint a City Manager for such duties, terms and for such compensation as shall be determined by City Council.

(b) No person holding the office of Mayor or the office of City Councilperson shall, during the term for which elected, be appointed to act as City Manager.

(c) In case of absence, disability or suspension of the City Manager, the Mayor, with the concurrence of a majority of all the members of the City Council, may designate some qualified person to perform the duties of the office during such absence, disability or suspension.”.

Section 2. Amend the Charter of The City of Lewes, Chapter 170, Volume 57, Laws of Delaware, as amended, Section 24. POLICE FORCE, by striking subsections (a), (b), and (c) thereof in their entirety and substituting in lieu thereof the following:

“(a) The City Council shall, from time to time, make such rules and regulations as may be necessary for the organization, government and control of a police force. The police force shall preserve peace and order and shall compel obedience within the corporate limits of the City to the ordinances of the City and the laws of the State of Delaware. The police force shall have such other duties as the City Council shall from time to time prescribe. The City Council may subject the Chief of Police and the members of the police force to the direction of the City Manager acting on behalf of the City Council.”.

Section 3. Amend the Charter of The City of Lewes, Chapter 170, Volumn 57, Laws of Delaware, as amended, Section 24. POLICE FORCE, by redesignating subsections (d), (e), and (f) thereof as subsections (b), (c), and (d) respectively.
