AN ACT TO AMEND TITLE 14 OF THE DELAWARE CODE RELATING TO THE DELAWARE STUDENT TESTING PROGRAM.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE :
Section 1. Amend Title 14, Chapter 1, Subchapter III, § 151(b) of the Delaware Code by adding the following sentence at the end of the subsection therein:
“Further provided, no later than the 2005-06 school year the Department shall conduct such assessments at not less than each grade three through grade eight, and not less than once at the high school level.”
Section 2. Amend Title 14, Chapter 1, Subchapter III, § 153(d) of the Delaware Code by deleting the paragraphs (5) and (8) in their entireties and renumbering the remaining paragraphs accordingly.
Section 3. Amend Title 14, Chapter 1, Subchapter III, § 153(d) renumbered paragraph (6) by striking the phrase “an offgrade” as it appears the first time in the first sentence therein and replacing it with the following phrase in lieu thereof:
“the statewide assessment pursuant to §151(b) at grade six (6) or seven (7) in mathematics or grades two (2), four (4), six (6) or seven (7) in reading whose score”.
Section 4. Amend Title 14, Chapter 1, Subchapter III, § 153(d) renumbered paragraph (6) by striking the word “offgrade” as it appears the second time in the first sentence.
Section 5. Amend Title 14, Chapter 1, Subchapter III, § 153(d) renumbered paragraph (6) by striking the words “an offgrade” as it appears in the second sentence of the paragraph therein and replacing with the words “ the statewide” in lieu thereof.
Section 6. Amend Title 14, Chapter 1, Subchapter III, § 153(d) renumbered paragraph (8) by deleting the last sentence of that paragraph.
Section 7. Amend Chapter 1, Subchapter III, § 153(d) renumbered paragraph (10) by deleting the reference “(2), (4), or (5)” and replacing in lieu thereof, the reference “(2) or (4)”.
Section 8. Amend Title 14, Chapter 1, Subchapter III, § 153(e)(2) by deleting subparagraph (2) in its entirety, deleting the numbering “(1)”, and leaving that text as subsection (e).
