AN ACT TO AMEND CHAPTER 288, VOLUME 64, LAWS OF DELAWARE, THE CHARTER OF THE TOWN OF LAUREL, AS AMENDED, TO ELIMINATE ONE AT-LARGE TOWN COUNCIL SEAT, TO PROVIDE THE MAYOR WITH THE RIGHT TO VOTE, AND TO PRESIDE AT COUNCIL MEETINGS, AND TO MANDATE THE ELECTION OF A PRESIDENT OF COUNCIL TO PRESIDE OVER COUNCIL MEETINGS IN THE ABSENCE OR DISABILITY OF THE MAYOR.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (Two-thirds of all members elected to each house thereof concurring therein):
Section 1. Amend Section 4(a) of Chapter 288, Volume 64, Laws of Delaware, the Charter of the Town of Laurel, as amended, by deleting "seven (7)" in the fourth line of such section and by substituting "six (6)" in lieu thereof, and by adding the following additional sentence:
"All references in this Charter to the Council or Town Council performing its functions shall be deemed to include the Mayor as a voting member thereof.".
Section 2. Amend Section 4(b) of Chapter 288, Volume 64, Laws of Delaware, the Charter of the Town of Laurel, as amended, by deleting "three (3)" in the third line of such section and substituting "two (2)" in lieu thereof.
Section 3. Amend Section 9(b) of Chapter 288, Volume 64, Laws of Delaware, the Charter of the Town of Laurel, as amended, by inserting "Mayor and" between "the" and "Town" in the second line thereof.
Section 4. Amend Section 11 of Chapter 288, Volume 64, Laws of Delaware, the Charter of the Town of Laurel, as amended, by inserting "The Mayor and Four (4) members elected to the Town Council, or…" at the beginning of such section.
Section 5. Amend Section 16(a) of Chapter 288, Volume 64, Laws of Delaware, the Charter of the Town of Laurel, as amended, by inserting a new sentence between the current first and second sentences reading as follows:
"He shall preside at all meetings of the Town Council, and he shall be entitled to vote on all matters presented to the Town Council for a vote."
Section 6. Amend Section 17(a) of Chapter 288, Volume 64, Laws of Delaware, the Charter of the Town of Laurel, as amended, by inserting", in the absence or disability of the Mayor," between "Council" and "and" in the fourth line thereof.
Section 7. Amend Section 18(a) of Chapter 288, Volume 64, Laws of Delaware, the Charter of the Town of Laurel, as amended, by inserting "or four (4) of the members of the Council and the Mayor," between "council," and "nor" in the eleventh line thereof.
Section 8. Amend Section 18(b) of Chapter 288, Volume 64, Laws of Delaware, the Charter of the Town of Laurel, as amended, by deleting the same in its entirety and substituting a new Section 18(b) of Chapter 288, Volume 64, Laws of Delaware, the Charter of the Town of Laurel, as amended, by deleting the same in its entirety and substituting a new Section 18(b) reading as follows:
"(b) Every ordinance, after it shall have been enrolled, shall be signed by either the Mayor or the President of the Town Council, or both, and the Secretary of the Town Council., within three days thereafter.".
Section 9. Amend Section 18(c) of Chapter 288, Volume 64, Laws of Delaware, the Charter of the Town of Laurel, as amended, by adding "or the Mayor, or both" at the end of the second line thereof.
Section 10. Amend Section 18(d) of Chapter 288, Volume 64, Laws of Delaware, the Charter of the Town of Laurel, as amended, by deleting the same in its entirety and substituting in lieu thereof the following:
"(d) Every ordinance not signed by either the Mayor or the President of the Town Council, and the Secretary of the Town Council, written three (3) days after its passage, shall become an ordinance as valid and effective as if it had been properly signed.".
Section 11. Amend Section 18(h) of Chapter 288, Volume 64, Laws of Delaware, the Charter of the Town of Laurel, as amended, by inserting ", or a Mayor," between "Council" and "who" in the first line thereof.
