AN ACT TO AMEND CHAPTER 339, VOLUME 62, LAWS OF DELAWARE, AS AMENDED, ENTITLED: "AN ACT TO RE-INCORPORATE THE TOWN OF SMYRNA" RELATING TO THE TOWN MANAGER AND CHIEF OF POLICE.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (Two-thirds of all members elected to each house thereof concurring therein):
Section 1. Amend §6(a)(1), 62 Laws of Delaware Chapter 339, as amended, by striking the first sentence thereof (beginning with the words "The Council shall appoint…") in its entirety and by substituting in lieu thereof a new first sentence as follows:
"The Council shall appoint a Town Manager who, subject to §6(b)(2) hereof, shall be the Chief Administrative Officer of the Town."
Section 2. Amend §6(b)(2), 62 Laws of Delaware Chapter 339, as amended, by striking the last sentence thereof ("The Chief of Police shall be subordinate and answerable to the Town Manager.") in its entirety and by substituting in lieu thereof a new last sentence as follows:
"The Chief of Police shall be responsible to the Mayor and Council for the proper administration of the Smyrna Police Department."
