AS AMENDED BY SENATE AMENDMENT NO. 1
AN ACT TO AUTHORIZE AND APPROVE THE TRANSFER OF CERTAIN REAL PROPERTY IN THE TOWN OF GEORGETOWN, SUSSEX COUNTY, DELAWARE.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (Three-fourths of all members elected to each house thereof concurring therein):
WHEREAS, the State of Delaware is desirous of acquiring certain real property in the Town of Georgetown, Delaware, known as 8 East Laurel Street, further identified in the land records of Sussex County as Parcel # 1-35-14.20-191, in order to facilitate the construction of the Sussex County Court of Chancery Building; and
WHEREAS, the State of Delaware is the owner of certain real property in the Town of Georgetown known as 9 & 11 East Laurel Street, further identified in the land records of Sussex County as Parcel #1-35-14.20-170; and
WHEREAS, the present owner of 8 East Laurel Street has agreed in principle to exchange his property for 9 & 11 East. Laurel Street owned by the State; and
WHEREAS, such an exchange will serve the best interests of both parties and the citizens of Delaware by enabling the timely completion of construction of the Sussex County Chancery Court.
NOW, THEREFORE:
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:
Section 1. Notwithstanding any provisions to the contrary, including those contained in Title 29, Chapters 94 & 95 of the Delaware Code, pertaining to the acquisition and disposition of real property, the Department of Administrative Services is authorized to negotiate the disposition of 9 & 11 East Laurel Street in exchange for the property at 8 East Laurel Street.
Section 2. The Department of Administrative Services is further authorized and empowered to prepare, have executed, and deliver to the owner of 8 East Laurel Street or his designee a good and sufficient deed and such other documents as shall be necessary to complete the exchange of properties.
Section 3. This bill becomes effective upon its enactment into law.
