AN ACT TO AMEND TITLE 15 OF THE DELAWARE CODE BY CODIFYING CERTAIN SECTIONS OF THE FISCAL YEAR 2002 BUDGET ACT.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE :
Section 1. Amend 15 Del. C. §4512, by adding thereto the following subsection to read as follows:
“(g) The Department of Elections may indemnify and hold harmless any U.S. Government entity for claims of damages arising from the State of Delaware contracting with said entity for the purposes of using their facility as a polling place to conduct elections. Furthermore, the State of Delaware shall purchase insurance against claims of damage to protect against such claims and indemnify the U.S. Government.”
Section 2. Amend 15 Del. C. §302(7) by adding the following to the end of said subsection:
“In addition, the Commissioner may develop standards and operating procedures for the purpose of having a statewide uniform election system. These standards shall be directed toward ensuring consistency in the redistricting process, the use of technology and the conduct of general, primary special and school elections. The Commissioner shall consult with the respective County Departments of Elections in developing these standards."
